Terms and Conditions
1. Scope of application
These terms and conditions apply to all orders placed by consumers (§ 1 Consumer Protection Act) or businesses via the online shop SaiyanGenetics/ saiyangenetics.myshopify.com.
2. Conclusion of contract
2.1 The presentation of products in the online shop does not constitute a binding offer.
2.2 By clicking the button "Submit order / buy", you place a binding order for the products contained in the shopping cart.
2.3 Acceptance takes place through an order confirmation by e-mail or by dispatch of the goods.
3. Prices and shipping costs
3.1 All prices are final prices and include the statutory sales tax.
3.2 Shipping costs will be shown separately.
4. Delivery and Delivery Time
4.1 Delivery will be made to the address provided by the customer.
4.2 Unless otherwise stated, the delivery time is [e.g. 3-5 working days].
5. Payment terms
Payment is possible immediately, e.g. by credit card, PayPal, bank transfer, etc. If you choose prepayment/bank transfer: Delivery after receipt of payment.
6. Retention of title
The goods remain our property until full payment has been received.
7. Warranty and Guarantee
7.1 The statutory warranty rights apply.
7.2 In case of defects, please notify us immediately so that we can check the defect.
8. Right of withdrawal
8.1 Consumers have a statutory 14-day right of withdrawal for distance selling contracts.
8.2 The period begins upon receipt of the goods.
8.3 To exercise the right of withdrawal, a declaration by e-mail or a return form etc. is sufficient.
8.4 We will cover the return shipping costs.
9. Exclusion of the right of withdrawal
Excluded are, for example, goods that are personalized, sealed for hygienic reasons and whose seal has been removed after delivery, etc. (where applicable).
10. Saving the contract text
We will save the contract text and send you the order details and our terms and conditions by email.
11. Data protection
We collect, process and store your personal data in accordance with the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act. Further information can be found in our privacy policy.
12. Applicable Law and Jurisdiction
12.1 The law of the Republic of Austria shall apply to all legal relationships, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
12.2 The place of jurisdiction, insofar as legally permissible, is Endresstraße 7, 1230 Vienna.
13. Final Provisions
Should any provision of these Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions. Instead of the invalid provision, the legally permissible provision shall apply.
